The F.I.R. has been lodged on 24.9.2005. But for the purpose of transferring the investigation from one Police Station to another Police Station the petitioner has made an application before the appropriate authority on 31.1.2006 and within a period of 21 days from the date of such application, the writ petition has been filed. It appears to us that the writ petition is premature in nature. The petitioner should have approached the Superintendent of Police, Aligarh for expeditious transfer of the investigation. At this stage, we do not find any reason to interfere with this writ petition. Therefore, the writ petition stands dismissed.
No order is passed as to costs.
However, this order will not prevent the petitioner from approaching the Superintendent of Police, Aligarh further.
