Heard Sri H.P. Dubey learned counsel for the petitioner; Shri Shishir Mehrotra for respondent no.1 and Shri C.B. Yadav, Chief Standing Counsel for respondent nos. 2,3 and 4. It has been pointed out by the learned counsel for the respondents that in respect of respondent no.5 earlier also there had been the same grievance for which a full fledged inquiry by the C.B.C.I.D was conducted and the report of the inquiry was placed before this Court and this Court disposed of the petition after being fully satisfied that the respondent no.5 was entitled for grant of Freedom Fighter pension.
In the facts and circumstances of the case as the matter has earlier been disposed of by a Division Bench of this Court in favour of respondent no.5, we do not see any ground to reopen the case.
The writ petition is accordingly dismissed.
