The applicant is  involved in Case Crime No. 37 of 1996, under Section 393, 307, I.P.C., Police Station, Hafizganj, District Bareilly.

Heard the learned counsel for the applicant and the learned A.G.A. for the prosecution.

The order sheet filed shows that the warrant of arrest was issued without service of summons. There is no mention in the order sheet that the summon was ever served on the accused-applicant.

In the circumstances, it is a fit case for bail.

Let the applicant Lalshah  be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
