HIGH COURT OF JUDICATURE OF ALLAHABAD

Court No. 48

Civil Misc. Contempt Petition No. 1092 of 1995

Ram Darash and another                         ....... Applicants/Petitioners

Versus

Kumari Kamlesh Priyadarshni and another.....Opposite parties.

****

Hon'ble S. P.Mehrotra, J.

The present Contempt Petition has been filed under Section 12 of the Contempt of Courts Act, 1971. It is, inter-alia, prayed that the opposite parties be punished for having committed contempt of this Court by allegedly disobeying the order dated 8-8-1994 passed by this Court in Civil Misc. Writ Petition No. 10924 of 1992.

The present Contempt Petition is being listed before the Court on various dates since August, 2004. However, on each such date, the learned counsel for the parties have not appeared before the Court even when the case has been taken up in the revised list.

Reference may be made to the orders dated 18-8-2004, 25-8-2004,    2-9-2004, 7-10-2004, 15-10-2004 and 23-11-2004, passed on the Order-Sheet.

The case has been taken up today in the revised list.

However, the learned counsel for the parties are not present.

Having regard to the nature of controversy involved in the present case and keeping in view the continued absence of the learned counsel for the parties in the present Contempt Petition, it appears that the present Contempt Petition has become infructuous by lapse of time.

In the circumstances, the Contempt Petition is dismissed as having become infructuous.

Show cause notices issued to the opposite parties, pursuant to the order dated 27-7-1995 passed on the Contempt Petition, are discharged.
