Heard learned Counsel for the applicant, learned A.G.A. and Sri Ashok Kumar Srivastava learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is mother-in-law of the deceased and she is lady. There is a general allegation against the applicant and other co-accused persons. Co-accused Manoj Kumar Tripathi alias Mahendra Kumar Tripathi devar of the ceceased and co-accused Deena Nath Tripathi the father in law of the deceawe4d have been released on bail 23.12.2005 and 20.2.2006 respectively. The case of the applicant is also on the same footing with the case of above mentioned co-accused, hence the applicant is also entitled for bail.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Pachwanti Devi involved in Case Crime No. 1654 of 2005, under Sections 498-A and 304-B1 I.P.C. and Sections 3/4 Dowry Prohibition Act, Police Station Robertsganj, District Sonebhadra be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
