Present writ petition was filed by one Ram Kesh, Son of Sri Budhai, Resident of Village Birbhanpur, Post Office and Tehsil Mehnagar, Pargana Bela Daultabad, District Azamgarh.
An application was moved by Ram Kesh through Sri P.C. Srivastava, learned counsel, that the writ petition was filed by some imposter. He did not file present petition. He has also filed an affidavit in support of the application. Ram Kesh is present in Court duly identified by Sri P.C. Srivastava, learned counsel for the applicant.
On the last occasion, Sri V.K.S. Chandel, learned counsel for the petitioner, was granted time to produce petitioner on 27th February, 2006. Today, he states that despite his intimation his client is not present in court.
Chief Judicial Magistrate, Azamgarh is directed to make an enquiry in the matter and take all appropriate steps to produce petitioner, who has filed present writ petition in the name of Ram Kesh and submit his report before the next date fixed after taking statement of Sri Lalta Yadav, Advocate who had identified petitioner.
List on 3rd April, 2006.
Registry is directed to send a copy of this order alongwith a photostat copy of the Vakalatnama to Chief Judicial Magistrate, Azamgarh to take all appropriate steps for compliance of the order forthwith.
