Learned counsel for the petitioner states that an auction for grant for fishery lease was held on 15.9.2005 in favour of respondent no.5 Brijendra Singh. The petitioner is inhabitant of the village. It is submitted by the petitioner's counsel that on account of situation of the pond and its utility to the inhabitants it was not proper to have given the pond on fishery lease. More so when the pond had earlier never been auctioned for fishery. The petitioner does not claim to have been interested in participating in the auction. He has rather challenged the pond being settled in favour of any person by grant of fishery lease. No right of the petitioner has been breached. It is not for the court to determine as to whether a particular pond should be given on lease or not, which is a matter relating to management and in the discretion of the authorities concerned. No ground for interference under Article 226 of the Constitution of India is made out. Dismissed.
