Final pension and Leave Encashment has not been determined in favour of the petitioner because of the pendency of the proceedings qua recovery of the loss caused to the State Government by the acts/inactions on the part of the petitioner during his employment. Petitioner is alleged to have submitted his reply to the notice issued in respect of alleged loss as early as on 28.12.2005, however final orders have not been passed till date.
Hence this petition.
In the facts and circumstances of the case this writ petition is disposed of with a direction upon respondent no. 3 to finalize the proceedings which have been initiated against the petitioner in respect whereof reply has been filed by the petitioner on 28.12.2005 (Annexure 4 to the writ petition), by means of a reasoned speaking order preferably within four weeks from the date a certified copy of this order is filed before him.
He shall also ensure payment of final Pension/Leave Encashment as may be due to the petitioner in accordance with law, within the same period.
