This writ petition has been filed by an Approved Guide Association for a direction to the respondents, particularly to the respondent no.5,Superintending Archeologist Archeological Survey of India,22 Mall Road, Agra Circle, Agra not to permit unauthorised persons to act as a guide at historical monuments at Agra.

It has been stated in the petition that under the Ancient Monuments and Archaeological Site and Remains Rules, 1959 hereinafter referred to as the (Rules) there is a prohibition for a person to show a visitor around for monetary consideration  except under the authority of, or under and in accordance with the conditions of a licence granted by an archeological officer. It has been contended by the learned counsel for the petitioner that inspite of the aforesaid prohibition contained in the Rules, certain persons are showing the visitors around the monuments for monetary consideration and for the said purpose they have filed various representations before the authorities.

In the facts and circumstances of the case, without issuing notice to the respondents as the matter is to be resolved by the statutory authorities, we dispose of this writ petition requesting the respondent nos. 5,7,8 and 9 to ensure the compliance of the statutory provisions of Rule 8 (D) of the said Rules, 1959, and they should not permit any person to show a visitor around for monetary consideration, unless it has been permitted by the authority under the Statute or he is in possession of a valid licence granted by the authorities under the said Rules or obtained an order from the competent Court.

A copy of the order may be filed before the said authorities for compliance.
