The applicant is involved in Case Crime No. 376 of 2003, under Section 302 I.P.C., Police Station Behjoi, District Moradabad.
Heard learned counsel for the applicant and learned A.G.A for the prosecution.
The prosecution case is that the co-accused Rajesh ( absconding) had made illegal demand of Rs. 50,000/ from Sarvesh, the deceased who had a shop of Electronic Goods. The deceased has refused to give the amount. On 17.10.2003 at about 7.00 P.M., Rajesh came to the shop of deceased alongwith his two associates including present applicant. All of them had country made pistals and all of them made fire from their pistals causing injuries to the deceased. The Post mortem report shows number of gun shot injuries on the dead body. The police has collected the evidence of eye witnesses. This defence has no force that the name of the accused-applicant has been taken in this case due to misunderstanding of his parrantage.
No ground for bail is made out.
The bail application is rejected.
