It is submitted by learned counsel for the applicant that the applicant was apprehended when he was carrying 25 kg beef and there is no other allegation against him. The recovery was not supported by any independent witness. The applicant is in jail since 12.1.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ashgar involved in Case Crime No. 51 of 2006 , under Sections 3/5/8/ Cow Slaughter Act Police Station Kotwali Khalilabad , District Sant Kabir Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
