The applicant is involved in Case Crime No.42 of 2005, under Section 376 I.P.C., Police Station Marka, district Banda.

Heard learned counsel for the applicant and learned A.G.A for the prosecution.

Perused the statement of girl recorded by the Magistate,under Section 164 Cr.P.C. She has corroborated the  case of prosecution. There is speific allegation of rape against this accused. No case for bail is made out.

Accordingly, the bail application is rejected.  Since the accused-applicant is in jail, therefore, the learned trial court is advised to conclude the hearing of the case as soon as possible.
