Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. Th alleged abducted person has been recovered from a open field by the police. The recovery was not made from the possession of the applicant. The name of the applicant was disclosed by abducted person. There is no allegation in respect of demand of ransom. The abducted person has returned back unhurt. The case of the applicant is distinguishable with the case of other-co-accused person.
It is opposed by the learned A.G.A. by submitting that the applicant is having criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Raj Kumar alias Pakka involved in Case Crime No. 297 of 2004, under Sections 364 I.P.C., Police Station Jalalabad, District Shahjahanpur be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicant shall appear in the court of learned C.J.M. in the first week of each month. In default of the above condition the bail granted to him shall be deemed cancel.
