Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is a farmer and he is uneducated persons. A cheque was given in the scheme of Sukha Rahat. It was given by the Lekhpal. The allegation against him is that he has added letter'4' and the amount of 2394/- was made 42394/- it is contended that in the cheque itself the aforesaid amount of R. 2394/- is clearly mentioned in the words. He is in jail for the last three months.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Samshuzzama involved in Case Crime No. 61 of 2005 , under Sections 419, 420, 467, 468 I.P.C.,Police Station Dhata , District Fatehpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
