It is submitted by learned counsel for the applicant that the applicant is dealer of fair price shop. A tractor loaded with the food grains was intercepted by the police. It is alleged that the tractor was taken for the purpose of black marketing. There is no independent to support the prosecution story. He is in jail since 26.2.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shiv Nath involved in Case Crime No. 17 of 2006, Under Sections 3419 and 420 I.P.C. and Section 3/7 E.C. Act, Police Station Kotwali Nagar, District Banda be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
