The supplementary affidavit filed today may be kept on record. It has been stated in the supplementary affidavit that residence/domicile of a particular village is not necessary for appointment as Anudeshika in the Unaupcharik Siksha Kendra and the petitioner while taking such appointment vide order dated 10.7.1991 and 10.8.1993, had not taken advantage of her domicile of village, Puramayapandey. Moreover, the impugned order cancelling the domicile certificate of the petitioner of village Mahul has been passed without giving an opportunity to the petitioner.
In view of the lack of opportunity of hearing, we set aside the order dated 23.1.2006 requiring the respondent no. 3 to re-examine the matter after considering any objection, which the petitioner may file before the respondent no. 3 along with the certified copy of this order within 15 days from today by a reasoned order.
The writ petition is allowed as above.
