At the out set Sri Mohammad Waris, Advocate,holding brief of Sri Durga Prasad, learned counsel for the petitioner, has stated that the petitioner is ready and willing to pay the remaining amount provided some breathing time is given. According to him the petitioner shall deposit the outstanding amount within two months.
We have heard learned counsel for the petitioner and Sri W.H. Khan, learned counsel appearing on behalf of the respondent no. 2.
Taking into consideration the statement made by the learned counsel for the petitioner, the writ petition is disposed of with the direction to the petitioner to deposit the entire outstanding amount within two months from today. For a period of two months further proceeding pursuant to the attachment notice shall remain stayed. However, if the petitioner deposits the entire amount the attachment notice shall stand withdrawn. In the event the petitioner fails to deposit the amount in question the authority will be at liberty to proceed to recover the remaining outstanding amount in accordance with law.
The writ petition is, accordingly, disposed of.
