Petitioner had approached this Court earlier seeking regular appointment as Collection Peon on the strength of his working as Seasonal Collection Peon for year together being writ petition no. 38130/01. The writ petition was disposed of on 27.11.2001 with a direction upon the Up Zila Adhikari to consider the claim of the petitioner for such regular appointment. In compliance of the orders passed by this Court, Up Zila Adhikari passed an order dated 23.8.2003 informing the petitioner that there is no existing vacancy for such regular appointment. However as and when subsequent vacancies become available his claim shall be considered in accordance with the judgment in the case of Jawaharlal Vs. District Magistrate, Kanpur.
Counsel for the petitioner submits that now the vacancies are available but the respondents have not considered the claim of the petitioner. Hence this petition.
Without entering into the merits of the claim set up by the petitioner it is provided that in case subsequent vacancies have become available within the quota for regular appointment of Seasonal Collection Peon, respondent no. 3 shall consider the claim of the petitioner for regular appointment strictly in accordance with law along with other such candidates who may be eligible, within four weeks from the date a certified copy of this order is filed before him.
Writ petition is disposed of.
