The applicant- Naresh Chandra Tiwari is involved in Case Crime No. 43 of 2004, under Sections 408, 409, 420, 468, 471, 477A, I.P.C., Police Station Puranpur, District Pilibhit.
Heard learned counsel for the applicant and learned A.G.A for the prosecution.
It is alleged by the prosecution that the accused-applicant is Incharge of purchase and delivery of paddy. It is further alleged that the paddy amounting to Rs. 3,84, 391/- was not delivered to the Factory concerned . It has been argued on behalf of the accused-applicant that the responsibility of purchase and delivery of pady was on the Secretary, Sri Virendra Singh, whose statement was recorded by the police. In his statement, he has stated that the entire original documents were last from his custody. He has not been made accused in this case. The offences are triable by the Magistrate Ist class.
In the circumstances, the applicant is entitled for bail.
Let the applicant, Naresh Chandra Tiwari be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
