Petitioner has already attained the age of 41 years and was admittedly more than 32 years of age when has father has expired. He seeks compassionate appointment under the provisions of U.P. Recruitment of Dependents of Government Servants (Dying in Harness) Rules, 1974.
In the opinion of the Court compassionate appointment under the aforesaid rules is not the alternative source of employment. Persons like the petitioner who has already attained the age of 32 years on the date of the death of his father cannot be said to be dependent. Therefore, petitioner has no right to claim compassionate appointment under the U.P. Recruitment of Dependents of Government Servants (Dying in Harness) Rules, 1974.
Writ petition is accordingly dismissed.
