According to the case of the petitioner, she got a construction plan passed from the prescribed authority under the U.P. Regulation of Building Operations Act, 1958 and constructed the residential house according to the sanctioned plan.
The learned counsel for the petitioner submits that the respondents are threatening to demolish the construction of the petitioner or its part without there being any proper proceedings under the said Act.
In view of these averments of the petitioner, the Standing Counsel may file a counter affidavit within one month. List thereafter.
In the meantime, if construction of the petitioner does not encroach upon any public passage, no part of the construction will be demolished unless there is an order for demolition passed by any competent Court or Authority under any Statute.
