Counter affidavit may be filed within four weeks. Rejoinder affidavit, if any, may be filed within three weeks thereafter.
Meanwhile, operation of the impugned judgement and order dated 6.1.2005 passed by Judicial Magistrate Ist, Shahjahanpur in Crl. Case No.5150 of 2003 (Smt. Vindhyawati Vs. Suresh Singh) under sections 125 Cr.P.C., Police Station Kanth, District Shahjahanpur and order dated 7.12.2005 passed by Addl. Sessions Judge, court No.1, Shahjahanpur in Crl. Revision No.40 of 2005 (Suresh Singh Vs. Smt. Vindhyawati) shall remain stayed provided the petitioner deposits Rs.16000/- (Sixteen Thousand) within two weeks and regularly pays the monthly maintenance at a rate of Rs.700/-(Seven hundred) per month from 1.5.2006. The amount so deposited may be withdrawn by the opposite party no.4. In case of breach of any of the conditions mentioned above, this order shall stand automatically vacated without any reference to this Court and the executive court shall take any steps so it likes.
