The petitioner is a defendant in a suit under Section 176 of U.P. Zamindari Abolition and Reforms Act. A preliminary decree was prepared in the suit. Thereafter proceeding for preparation of the final decree took place. The kuras were prepared. The finding is that although the petitioner was served and had filed written statement but he did not file any objection to the kuras. The lekhpal who was examined made a statement that the kuras were made taking into account the valuation of the plots and possession and on the basis of consent.
Learned counsel for the petitioner has not shown anything to indicate that the kuras allotted to the parties were unjust. He submits that the productive lands have been given to the respondents and unproductive land has been given to the petitioner but no material to demonstrate this fact has at all been produced. The findings recorded by the courts below are findings of fact. There is no merit in this petition. Dismissed.
