Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was traveling in a train. There was a dispute over the sitting of berths. It is said that some clothes of the first informant have been stolen. The applicant was arrested on the spot whereas other three accused persons successfully escaped from the place of the occurrence. No stolen clothes have been recovered from the possession of the applicant. The applicants are in jail since 16.1.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Dhani Ram, involved in Case Crime No. 2 of 2006, under Section 379 I.P.C., Police Station G.R.P. Chauki, District Bijnor be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
