Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicants that according to prosecution version only four country made bombs have been recovered from the possession of the applicant. The recovery was not supported by any public witness. The applicant is in jail since 4.12.2005.
It is opposed by the learned A.G.A. by submitting that the applicant is having criminal antecedent.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Lomadi alias Raj Kumar Yadav involved in Case Crime No. 174 of 2005 , under Sections 4/5 Explosive Substance Act.,Police Station Daraganj , District Allahabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicant shall appear before the C.J.M. concerned in the first week of each month, in default it shall be open to the learned Sessions Judge concerned to cancel the bail of the applicant granted to hi,
