Heard Sri L. D. Rajbhar, learned counsel for the petitioners, Sri J. R.s. Tomar, learned counsel for the informant, learned A.G.A. and perused the record.
There are allegations and counter allegations and in this regard a case as Case Crime No. 5 of 2006 under Section 307 IPC and another as Case Crime No. 5-A of 2006 under Sections 307, 504, 506 IPC have been registered. Accused in Case Crime No. 5 of 2006 have already filed Criminal Misc. Writ Petition No. 1358 of 2006 for quashing of the F.I.R. but a division bench of this Court on 6.2.2006 dismissed the writ petition and expedited the bail application of the petitioners, wherein none is alleged to have sustained injury.
In the present case one Dhanno @ Sanjay is alleged to have sustained injury in the occurrence.
Considering the facts and circumstances, there appears no justification to interfere in the F.I.R., therefore, the petition lacks merits and is liable to be dismissed.
The writ petition is hereby dismissed. However, in the event, if the petitioners put in their appearance or produced before the Court concerned in Case Crime No. 5-A of 2006 under Sections 307, 504, 506 IPC, P.S. Rajpur, District Kanpur Dehat and make application for released on bail, their bail application shall be disposed of in accordance with law.
