Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
If no resolution has been passed allotting fair price shop, of which the petitioner's father was licensee, till the date on which certified copy of this order is presented before the respondent No.3, the said respondent No.3 may consider, while taking its decision in this behalf, whether the petitioner should be recommended for grant of fair price shop of his father on compassionate ground in terms of the Government Order dated 17.8.2002 (clause 7 thereof). For this purpose the petitioner will produce before the respondent No. 3 a certified copy of this order along with an accurate copy of said Government Order attested by the petitioner himself. If such recommendation is made in favour of the petitioner by the respondent No. 3, and the same is sent for approval before the respondent No. 2, the respondent No. 2 will also consider such proposal in the light of the said Government Order.
The writ petition is disposed of as above.
