Heard learned counsel for the petitioner.
This petition challenges the order of the Tribunal dated 28.9.2005 whereby award of a sum of Rs. 4,000/- has been made by the Motor Accident Claim Tribunal in Case No. 153 of 2002.
Learned counsel submits that the court below has wrongly relied upon the witnesses, who have been produced for proving the claim of the respondent. The only witness, who is intact happens to be his friend and he has also been cited as a witness in criminal case by the respondent against the petitioner.
The court below has believed the witness produced by the claimant and has given certain reasons for that and this court sitting in writ jurisdiction will not re-appreciate the evidence of that witness to declare him as unbelievable.
The petition, thus, does not appear to have any substance and is hereby dismissed.
