Heard learned counsel for the petitioner and Sri Vivek Singh for the respondents.

The petitioner wants refund of the licence fee on the ground that he could not operate the licence because of non-cooperation by the respondents. Whether this contention is correct or not is a pure question of fact, which can not be adjudicated in writ jurisdiction. Therefore, the petitioner may avail of the arbitration clause.

The writ petition is not being entertained. It is accordingly dismissed.
