Kiran Kumar Sarkar v. Additional District Judge Court No.17, Allahabad - WRIT - C No. 13942 of 2006 RD-AH 5540 (8 March 2006)
Hon'ble Umeshwar Pandey, J.
Heard learned counsel for the petitioner.
Petitioner's application for temporary injunction was rejected by the trial court in default against which the petitioner preferred an appeal, which has been dismissed and directions have been issued by the revisional court for trial court to dispose of the restoration application-53 C. It is against this order that this petition has been presented.
Since the temporary injunction was dismissed in default, the remedy which lay before the petitioner was to move the trial court for its restoration, which has already been done. The revisional court has very rightly directed the court below for disposal of the restoration application. I do not find any infirmity in the said order as to interfere against the same in this petition, which is without merit and is hereby dismissed.
