This writ petition has been filed raising the grievance that without passing the order of suspension or cancellation by the Prescribed Authority, the supply of essential commodity has been stopped vide impugned order dated 16/2/2006 only on the ground that the petitioner i.e. the licensee of a fair price shop has not paid certain outstanding dues to certain society.
We have heard Sri N.K. Singh, learned counsel for the petitioner; learned Standing Counsel for respondent nos.1 to 3 and Sri Singh for respondent no.4.
We are of the considered opinion that unless the order of suspension or cancellation of the licence of the fair price shop is passed, the supply of the essential commodities cannot be stopped. In view thereof, the order dated 16/2/2006 is hereby quashed and the respondents are directed to supply the essential commodities regularly to the petitioner. However, the respondents shall be at liberty to pass appropriate order in accordance with law.
In view of the above, the writ petition stands disposed of.
