Smt. Padma v. Smt. Nirmala Devi And Others - WRIT - C No. 14031 of 2006 RD-AH 5636 (8 March 2006)
HON'BLE UMESHWAR PANDEY, J.
Heard the learned counsel for the petitioner.
This petition challenges the order of the trial court dated 21.10.2005 and order dated 17.1.2006 passed by the revisional court.
By the impugned orders, the courts below have allowed the amendment application of the respondent-plaintiff whereby she proposed to incorporate certain corrections in the boundary given in the plaint describing the property in question. These corrections are such corrections which do not set up any new case of the plaintiff nor does it carve out any new cause of action for her.
In the aforesaid view of the matter the court below have granted the prayer for amendment and the orders passed by them do not have any legal or otherwise infirmity as to warrant an interference against it in extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India.
The petition does not appear to have any force and is hereby dismissed.
