Heard learned counsel for the appellant and learned .A.G.A for the State.
The only role assigned to the appellant is of catching hold. The role of firing was assigned to the other co-accused Sukhey. The case of the appellant is distinguishable from the case of other co-accused.
In the circumstances, let the appellant, Chandan, convicted and sentenced in S.T. No. 570/99 (State Vs. Sukhey & others) shall be released on bail during the pendency of this appeal before this court on his furnishing a personal bond alongwith two sureties each in the like amount to the satisfaction of C.J.M. Budaun.
Realisation of fine shall remain stayed.
