Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The allegation against him is aht from his possession one stolen motor cycle has been recovered. The recovery was not supported by any publice witnesses. The applicant is in jail since 24.12.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Prateek Yadav involved in Case Crime No. 79 of 2005, under Sections 379 I.P.C., Case Crime No. Nil of 2005, under Section 41/411 I.P.C. Police Station Barhpura and Kotwali , District Etawah be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
