We have heard learned counsel for the petitioner, Shri Neeraj Tripathi for the Chancellor, Standing Counsel for the State and Shri Anurag Khanna for the University.

The petitioner's educational institution was granted temporary affiliation for the academic year 2004-05 after recognition by the NCTE.

According to the case of the petitioner in this writ petition, the permanent affiliation was recommended by the University panel, which did not point out any objection or shortcoming. However, the Chancellor by the impugned order dated 17.9.2005, Annexure 10 to this writ petition  has refused affiliation without giving any reasons.

In view of these averments, we allow this writ petition, set aside the impugned order dated 17.9.2005 requiring the Chancellor to reconsider the matter with reasons at his earliest convenience.

In the meantime, till the decision is taken by the Chancellor or till the end of current academic year session 2005-06 whichever is earlier, the temporary affiliation granted to the petitioner's educational institution will be continued.
