Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The only allegatiion against him is that one stolen motor cycle was recovered from his possession. The recovery was not supported by any public witness. . The applicant is in jail since 17.7. 2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Arif involved in Case Crime No. 317 of 2005 , under Sections 379 and 411 I.P.C.,Police Station Dadri, District Gautam Buddha Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
