Heard learned Counsel for the applicant and learned A.G.A. and Sri R.N. Upadhyaya learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the alleged occurrence had taken place in a sudden quarrel. The role of firing is assigned to the applicant and other co-accuse persons. Consequently, 8 persons received injuries. The nature of injuries shows that none of the injury was grievous or dangerous to life. The applicant is in jail since 14.2.2006.
It is opposed by the learned A.G.A. and the learned counsel for the complainant by submitting that the applicant is having criminal antecedents and some other cases are pending against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Gulam Sanjari involved in Case Crime No. 96 of 2006, under Sections 307, 452, 504, and 506 I.P.C. , Police Station Bhadohi , District Santravidas Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned with the condition the applicant shall report to the court of learned CJ.M. Concerned till the conclusion of the trial in the first week of each month, in default it shall be open to the learned Sessions Judge to cancel the bail of the applicant granted to him.
