Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicants that even upon the prosecution version on Rs. 5000/- has been paid by the first informant. The same was transferred to co-accused Raj Nath Chaubey in his presence. It is said that the first informant has paid a sum or Rs. 20000/- to co-accused Raj Nath Chaubey at the house of the applicant. The case of the applicant is distinguishable with the case of co-accuse Raj Nath Chaubey.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Haribans Pandey involved in Case Crime No. 50 of 2005, under Sections 420 and 506 I.P.C. , Police Station Gola , District Gorakhpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
