Harikesh Prasad v. Rakesh Singh, District Basic Education Officer & Others - CONTEMPT APPLICATION (CIVIL) No. 1103 of 2006 RD-AH 5882 (10 March 2006)
Hon. Tarun Agarwala,J.
The applicant alleges that the order dated 18.7.2005 which was affirmed by the appellate court on 5.8.2005 is not being complied with by the opposite parties. The contention of the applicant is that upon the dismissal of the writ petition of Smt. Shakuntala Devi, the applicant was entitled to be considered to be appointed on the post of Shiksha Mitra which is not being considered by the opposite parties. Therefore, willful disobedience is being committed by the opposite parties.
In the opinion of the Court, if the case of the applicant is not being considered by the opposite parties, the remedy for the redressal of his grievance is not in the contempt jurisdiction, but lies before another forum.
The application is dismissed.
