Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He was well known to the first informant because he also carrying a business and the applicant was having the business contract to the first informant. After 40 days of the alleged occurrence a sum of Rs. 40,000/- has been recovered from the possession of the applicant. The recovered notes were not having any specific mark to show that they were stolen property. The recovery was not supported by any independent witness. The applicant is in jail since 15.1.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Vimlesh alias Bhoora involved in Case Crime No. 448 of 2005, under Sections 392 and 411, Police Station Sikandara Rao , District Hathras be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
