Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the from the godown of the applicant only 650 litres of kerosene has been recovered. The applicant was not having any authority to keep that kerosene oil and no license was in his favour. The recovery was not supported by any independent witness. He is in jail since 2.2.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Vinod Kumar involved in Case Crime No. 37 of 2006, under Section Sections 3/7 of the E.C. Act, Police Station Sadar Bazar , District Shahajahanpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
