Mehnaz Wali Khan And Another v. State Of U.P. And Others - WRIT - C No. 13985 of 2006 RD-AH 6049 (20 March 2006)
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Dilip Gupta, J.
This writ petition has been filed raising the grievance that petitioners are major and have married voluntarily out of love and affection without any fraud coercion or pressure. The respondent no.4 i.e. the father of petitioner no.1 is not happy with the marriage of the petitioners, therefore the other respondents are harassing them and are not permitting them to lead a happy married live.
We have called the petitioners and examined them. The petitioner no.1 had stated that she got married with the petitioner no.2 out of love and affection without any force and she is happy with the marriage and wants to live with her husband and the respondents should be restrained from harassing them. Documents have been filed to satisfy the Court that both the petitioners are major and the date of birth of petitioner no.1 is 14/12/1985.
In view of the above, we dispose of this petition after hearing learned Standing Counsel for respondent nos. 1 to 3 with the request to the respondent no.2 to ensure the safety of the petitioners and prevent any person to harass them because of their marriage.
