Heard learned Counsel for the applicant and learned A.G.A.
This is second bail application. The Criminal Misc first Bail Application No. 13867 of 2005 has been rejected by this court 0n 18.11.2005, considering the case on its merits.
It is submitted by learned counsel for the applicant that the applicant is in jail since 5.4.2005, but till today no charge sheet has been submitted in this case in the court concerned. The applicant is entitled to get benefit of the provisions of Section 167(2) Cr.P.C. It has not been controverted by the learned A.G.A., but it is submitted that till today no sanction has been granted by the authority concerned, that is why the charge sheet has not been submitted in the court concerned.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and considering the provisions of Section 167(2) Cr. P. C. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Yogendra Singh involved in Case Crime No. 66 of 2005, under Sections 409, 420, 467, 468, 471, 109 I.P.C. and Sections 13(i) d of the Prevention of Corruption Act, Police Station Kotwali Nagar , District Gonda be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
