Sri Krishna Gupta v. State Of U.P. And Others - WRIT - C No. 1275 of 2006 RD-AH 611 (9 January 2006)
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Dilip Gupta, J.
The petitioner has raised a grievance against private respondent nos. 4 and 5 that they are threatening to dispossess the petitioner. The petitioner has also placed before us the order passed in Testamentary Case No. 2 of 1988, pending in this Court and in which petitioner also claims to be a party.
Learned counsel for the petitioner contended that the respondent nos. 4 and 5 are threatening to dispossess the petitioner, which would be in contravention of the order passed in the aforesaid Testamentary Case.
We are of the considered opinion that it is for the petitioner to move an appropriate application in the pending testamentary case, and therefore, this petition cannot be entertained.
The petition is accordingly dismissed.
