HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Janardan Sahai, J

Proceedings under Section 122-B of the U.P. Zamindari Abolition & Land Reforms Act were initiated against the petitioner. The petitioner filed objections taking the plea that he is in possession over the land in dispute since before Zamindari Abolition. The Tehsildar directed eviction of the petitioner and also imposed damages. The revision filed by the petitioners has been dismissed. The finding is that the no evidence was led by petitioner to establish his possession since before the Zamindari Abolition and that the land is public land being Khalihan. The finding is one of fact. No ground for interference with the orders passed by the authorities has been made out. Dismissed.
