Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that according to prosecution version 3 quintals beef was recovered from the possession of the applicant. There is no evidence to show that the applicants have slaughtered the cows and there is no evidence of selling the same. The only evidence in respect of possession of the beef is against the applicants. The recovery was not supported by any independent witness. The applicants are in jail since 16.2.2006
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and learned A.G.A. and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Bhura and Danish involved in Case Crime No. 202 of 2005, under Sections 3,5, and 8 of the Cow Slaughter Act., Police Station Nai Mandi , District Muzaffarnagar be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
