This writ petition has been filed for quashing the citation issued by the Tehsildar, Tehsil Karvi, District Chitrakoot and for a direction to the respondents to adjust the amount of Rs. 25,000/- already deposited by the petitioner in respect of the dues.

The petitioner, who has appeared in person before us, has submitted that the he has deposited an amount of Rs. 25000/- in respect of the dues, but still the citation has been issued, without adjusting the said amount, therefore, there is an error in the said citation which needs to be rectified.

Shri W.H. Khan, learned counsel appearing for the respondent no.3 has stated that for the said purpose the petitioner may move a representation before the Executive Engineer, Viddhut Vitaran Khand, District Chitrakoot i.e. respondent no.3 who shall examine the same and thereafter issue a demand notice within three days. Petitioner then may deposit the amount within a period of two days thereafter.

In view of the aforesaid statement, we allow the writ petition and quash the citation issued against the petitioner and direct that in the event petitioner files a representation within a period of three days from today, the Corporation shall consider the same and issue a fresh demand notice to the petitioner within a period of two days so that he may deposit it by 31/3/2006 in order to avail the benefit of exemption.

A copy of this order be given to the learned counsel for the petitioner by tomorrow on payment of usual charges.
