HIGH COURT OF JUDICATURE OF ALLAHABAD

COURT NO.34

Civil Misc. Writ Petition No.1082 of 2006

Yogi Nath Degree College, Sarurpur Kalan, Baghpat

Versus

State of U.P. & Ors.

Hon'ble Dr. B.S. Chauhan, J.

Hon'ble Dilip Gupta, J.

This writ petition has been filed for quashing the impugned order dated 02.01.2006 passed by the Registrar, Choudhary Charan Sinsgh University, Meerut (hereinafter called the ''University') on the basis of order dated 12.12.2005 passed by the Chancellor of the University.

A perusal of the order dated 12.12.2005 passed by the learned Chancellor of the University indicates that the reasons have been indicated in the order for refusing the grant of affiliation to the petitioner Institution for B. Ed. Course for academic session 2005-2006.

We have heard Shri Pankaj Misra, learned counsel for the petitioner, Shri Neeraj Tripathi, learned counsel for respondent no.2, Shri Anurag Khanna, learned counsel for respondent no. 3 and the learned Standing Counsel for respondent no.1.

Shri Pankaj Mishra, learned counsel for the petitioner has stated that after the passing of the order by the learned Chancellor of the University, the petitioner College has complied with the necessary terms and conditions and  therefore the matter may be re-examined by the learned Chancellor.

Shri Neeraj Tripathi, learned counsel appearing for the Chancellor of the University has submitted that the petitioner may place the necessary documents before the Chancellor of the University and in the event the petitioner does so, the learned Chancellor shall examine them and pass appropriate orders in accordance with law. For the said purpose, he has further submitted that the Chancellor shall give opportunity of hearing to all the parties concerned including the University to find out as to whether the terms and conditions have been complied with.

In view of the submissions made by learned counsel for the parties, we dispose of this writ petition requesting the learned Chancellor of the University to consider the matter afresh relating to grant of affiliation for B. Ed. Course for academic session 2005-2006 in accordance with law on the basis of documents sought to be produced by the petitioner after giving opportunity to all concerned.

We have no reason to doubt that in case petitioner submits the necessary documents, the learned Chancellor shall pass appropriate orders at an early date.
