This is an application for bail moved on behalf of the applicants Anil alias Kukku and Brijesh alias Videsh involved in case Crime No. 1154 of 2005 under sections 379, 411 I.P.C., Police station Civil Lines, district Muzaffarnagar.

Heard Sri Amit Daga, learned counsel for the applicants, learned AGA and have perused the record.

The learned counsel for the applicants submitted that motorcycles said to have been recovered from the possession of the applicants do not relate to the offence in question. The learned counsel pointed out that recovery of stolen motorcycle Hero Honda CBZ bearing chasis No. 00444 and Engine No. 01398 was made from the possession of co-accused Jogender.

The learned AGA argued that  recovery of stolen motorcycles from the possession of each of the applicants  was made.

I have taken into consideration the submissions advanced on behalf of both the parties.

The motorcycle recovered from the possession of each of the applicants have not been connected with any offence of theft. The recovery of stolen motorcycle of the complainant was made from the possession  of co-accused Jogender. In view of these facts, I consider it to be a fit case for bail.

Let the applicants Anil alias Kukku and Brijesh alias Videsh involved in case Crime No. 1154 of 2005 under sections 379, 411 I.P.C., Police station Civil Lines, district Muzaffarnagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
