Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The alleged abducted persons has returned back to his house after 10 days of the alleged occurrence. The recovery was not made from the possession of the applicant and there is no allegation in respect of demand of ransom. The only allegation against him is that his name has been disclosed due that he used to go to the house of the abducted person.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Madhu alias Ram Prakash involved in Case Crime No. 193 of 2005, under Sections 364, 368 and 120-B I.P.C., Police Station Baldev , District Mathura be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
